The rules for selected photos, requested AI edits, connected accounts, and consumable credits.
These Terms of Use govern Misenlume on iOS. By downloading, accessing, purchasing through, or using Misenlume, you agree to these Terms, Apple’s applicable terms, and the Misenlume Privacy Policy. If you do not agree, do not use the service.
You must be at least 18 or have reached the legal age of majority where you live, and you must be legally able to enter into this agreement.
SW Cosmos Inc. grants you a limited, personal or internal-business, non-exclusive, non-transferable, revocable license to use Misenlume as permitted by these Terms and App Store rules.
A secure Misenlume session may begin as a guest and may later be connected with Apple or email. You are responsible for protecting access to your device and connected account.
You retain the rights you already hold in photos and instructions you submit. You grant SW Cosmos and its service providers the limited rights needed to upload, transmit, process, transform, temporarily store, and return that content to provide the feature you request, secure the service, investigate failures or reports, and provide support.
You must have the rights and permission needed for each image and person you submit. Do not upload unlawful, deceptive, infringing, abusive, exploitative, or privacy-violating content.
Misenlume uses fal.ai and AI models made available through its service. AI output can change facial, body, clothing, lighting, background, or other details and may be inaccurate or unexpected. Review every result before publishing, using it commercially, or relying on it. A generated scene is not proof that a person visited a location.
Standard generations use the free allowance shown in the app and include a visible Misenlume watermark. HD costs one purchased credit and 4K costs two purchased credits unless the app clearly shows a different cost before generation.
Purchased credits are consumable, do not expire, have no cash value, cannot be resold, and are stored in the connected Misenlume account. Apple processes the purchase and shows the price, currency, and applicable tax before confirmation.
When a server-confirmed paid generation fails before delivery, Misenlume is designed to restore the charged credits automatically and exactly once. Completed deliveries, duplicate requests, abuse, or violations of these Terms may not qualify for restoration.
You may not use Misenlume to create illegal content; impersonate or exploit a person; create deceptive endorsements; infringe intellectual-property, privacy, or publicity rights; sexualize or exploit minors; evade safety controls; probe, scrape, reverse engineer, disrupt, or overload the service; automate purchases or accounts abusively; or use stolen credentials or payment methods.
We may block a request, preserve relevant evidence, limit service, remove access to content, or suspend an account when reasonably necessary to protect people, rights holders, stores, providers, or service integrity.
Misenlume depends on network access, Apple, Supabase, fal.ai, and related infrastructure. Models, processing time, quality, compatibility, pricing, features, and availability may change. We may require updates or discontinue a feature when reasonably necessary.
Third-party services have their own terms and policies. These Terms do not override mandatory consumer protections or App Store rules.
To the fullest extent permitted by law, Misenlume is provided “as is” and “as available.” SW Cosmos disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing excludes a warranty or remedy that applicable law does not allow us to exclude.
To the fullest extent permitted by law, SW Cosmos will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost business, or lost data arising from Misenlume. Where liability cannot be excluded, aggregate liability will not exceed the greater of the amount you paid for Misenlume during the twelve months before the claim or US $100, except where applicable law requires otherwise.
You may stop using Misenlume at any time and may delete the Misenlume account and app data from Settings > Account. We may suspend or terminate access for a material or repeated violation, fraud, security risk, legal requirement, or prolonged service discontinuation.
The in-app deletion flow requires a fresh identity check before deletion: fresh Apple authorization for an Apple-linked account or a recent email one-time-code authentication for an email-linked account. After fresh Apple proof is verified, Misenlume attempts to revoke the Sign in with Apple authorization issued specifically to Misenlume while preserving the shared SW Cosmos sign-in record and data belonging to other SW Cosmos products.
Required transaction, accounting, refund, fraud-prevention, security, dispute, or deletion-audit records may be retained as described in the Privacy Policy. Deleting Misenlume does not cancel or refund completed consumable App Store purchases.
We may update these Terms to reflect changes in Misenlume, store rules, law, safety, providers, or business operations. We will post revised Terms with an updated effective date and provide additional notice when required.
These Terms are governed by the laws applicable to SW Cosmos Inc., without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply. Questions may be sent to info@swcosmos.com.
